Sale and purchase of real property
On appointment by the court the Official Solicitor can act as trustee to facilitate the sale and purchase of real property where a trustee of the land is under a legal disability, usually an adult lacking capacity to manage their affairs.
An incapable party to a divorce may be ordered to transfer jointly held property to another person or the property may be sold. The Official Solicitor may, if there is no other suitable and willing person to do so, act both as trustee and to do the conveyancing as required under Law of Property Act s.22.
